General provisions

These General Conditions of Sale (hereinafter also referred to as GCS) are valid between Compass DHM projects of Mattia Compagnin (with registered and operational headquarters in via Righe 13, 35028 Piove di Sacco (PD), Italy, VAT number 04879160283, CF CMPMTT92C30G693E , REA PD - 425486) hereinafter referred to as "Compass DHM projects" and any person, natural or legal, who makes online purchases (of goods and / or services) on the website www.compassdhmprojects.it hereinafter referred to as "Customer", " Consumer ”, or“ Buyer ”.  

These conditions govern purchases made on the website www.compassdhmprojects.it, in accordance with the provisions of the law referred to in the Civil Code, Legislative Decree no. 70/2003 on information society services and electronic commerce and Legislative Decree no. 206/2005 (so-called Consumer Code), amended by Legislative Decree. n. 21/2014. The protection of confidentiality will be subject to the discipline of Legislative Decree 196/2003.  

 

Article 0 - Definitions

Customer - Consumer - Buyer : terms used in these GCS synonymously, indicate the physical or legal subject who places an order for goods and / or services from Compass DHM projects 

Order confirmation : indicates the acceptance of the Order by the Seller sent to the Buyer

Contract : means the contract concluded from time to time between the Customer and the Seller for the purchase of goods and / or the supply of services subject to these General Conditions of Sale   

Days : indicates the working days, from Monday to Friday (inclusive) not holidays

Working hours : it means the working hours of the Seller, specifically it means from Monday to Friday from 09.00 to 13.00 and from 15.00 to 19.00. 

Order - Order : terms used in this GCS synonymously, indicate a purchase order for Products sent by the Buyer to the Seller 

Product : indicates the good and / or the provision of a service offered by the Seller 

Website : the website www.compassdhmprojects.it  

User : indicates the physical or legal person who has already registered on the Seller's Site, and therefore a potential Buyer.

Seller : indicates Compass DHM projects, supplier of goods and / or services present on www.compassdhmprojects.it

Visitor : means any person who views the Seller's Site.

 

Article 1 - Seller

"Seller" means Compass DHM projects, with registered and operational headquarters in via Righe 13, 35028 Piove di Sacco (PD), Italy.

 

Article 2 - Acceptance of the General Conditions of Sale

The conditions set out in the introduction are an integral and essential part of this Agreement.

The visitor who intends to make a purchase on the site www.compassdhmprojects.it must first register to create a personal account, becoming a "User".

At this stage he is required to complete the required fields by entering real and correct data to proceed with the delivery of the goods and by entering active and functioning e-mail addresses in order to receive communications relating to his orders from the Seller. At any time, the User can modify their data directly from the dedicated personal area. To register, you must be of legal age. If a minor is interested in purchasing Products on the Site, he must involve a parent or guardian. Registration is free.

All contracts will be concluded directly through the access by the User to the Internet site corresponding to the address www.compassdhmprojects.it, where he can conclude the Contract for the purchase of the desired Product by carefully following the instructions and procedures provided.   

These General Conditions of Sale must be examined by the Customer before completing the purchase procedure. The forwarding of the Order Confirmation implies full knowledge of the same and their full acceptance. Customers are advised to store and / or print the GCS present at the time of purchase. At any time, however, the registered User can view these GCS. 

By accepting the GCS set out here, the User also accepts the fact that Compass DHM projects may deactivate the account and refuse or cancel orders from: from Users who have violated these GCS, from Users who have released false, incomplete or however inaccurate, by Users who have not completed the payment for previously placed orders. Compass DHM projects reserves the right to inform the competent Authorities in the event of any criminal and / or civil liability.

 

Article 3 - Product presentation, sales prices

All sales prices of the Products indicated on the website www.compassdhmprojects.it are expressed in Euros and include VAT applicable by law. Packaging and shipping costs are not included in the purchase price, unless specifically indicated, but are indicated and calculated at the time of the conclusion of the purchase process before payment is made. 

The prices of the items visible on the Site may undergo periodic changes based on the adjustment of the price lists of our suppliers. In the event of an IT, manual, technical, or any other type of error that could result in a substantial change, not foreseen by Compass DHM projects, of the retail price, the purchase order will be considered invalid and canceled and the amount paid by the customer will be refunded within 14 days. from the day of cancellation.  

The Products will be invoiced on the basis of the rates in effect at the time the order is confirmed.

The products offered comply with the Italian legislation in force and with the rules applicable in Italy and in Europe.

Compass DHM projects reserves the right to withdraw any Product from the Site at any time and / or remove or publish any type of material and / or content. It also reserves the right to modify and / or remove any form of promotion: the offers published on the Site have a limited time duration and a limited quantity of Products.

The technical data sheets and details of each Product on the Site are constantly updated, nevertheless there may be errors and / or inaccuracies and / or defects in correspondence between the descriptions and the actual Product. Compass DHM projects declines all responsibility for any lack of correspondence. The photos inserted for each Product are indicative and not contractual, so they may not correspond in color, size or accessories. 

The estimate of products cut to size and / or customized is valid only for the specifications on which it was based. Any changes made require an updated quote. Quotations are valid for the calendar day on which they are issued, after which the price can change without notice.

 

Article 4 - Stock of Products 

The availability of the Products can be viewed in each Product page and refers to the actual availability at the time the Customer places the order.

A Product can be "Available" (it is present in our warehouse), "On order" (the Product can only be purchased on order), "Not available" (the Product is not available, but on its way). 

This availability must in any case be considered purely indicative because, due to IT problems, the quantities indicated could be wrong, or due to the simultaneous presence on the Site of multiple Users, the Products could be sold to other Customers before confirming the order.

Even after receiving the order confirmation e-mail sent by Compass DHM projects, there may be cases of partial or total unavailability of the goods. In this case, the Customer will be contacted directly by the Seller to establish a deferred delivery, an order modification and a rectification.

 

Article 5 - Methods of payment

The payment methods are specified at the time of purchase. The User has the following methods available: Credit or prepaid cards, PayPal, or advance bank transfer.

POS / BANCA SELLA : payment through the Banca Sella form.

Paypal : payment through your paypal account.

Alternatively, it is possible to pay directly online by credit card through Paypal, even without having an account. 

You will be directed from the payment module to the Paypal screen, where you can possibly select the item "I don't have a Paypal account" and enter all the details of your card to complete the payment.

The transaction is finalized on the Paypal Site, in order to protect your card information thanks to security and prevention systems.

BANK TRANSFER : In case of payment by bank or postal transfer, in advance, the order will be managed only after receiving the confirmation of the credit. 

The data to make the transfer will be provided at the time of the order confirmation.

BILLING

We issue an invoice with a separate VAT indication. This is to be requested at the time of the Order Confirmation by ticking the appropriate box and entering the necessary data (company name, registered office, tax code and VAT number). 

The invoice will be sent by e-mail to the e-mail address provided during registration.

In the event that the appropriate box is not checked at the time of the order, and consequently the request is not forwarded to the Seller, the transaction will be recorded in the fee register. It will therefore no longer be possible to request the commercial invoice relating to the order. 

 

Article 6 - Modification and cancellation of the Order

Compass DHM projects offers the possibility to modify or cancel an Order in accordance with the clauses specified here.

The Customer can request the free cancellation of an Order only on the day of receipt of the Order Confirmation by the Seller, provided that the order is still in the status "awaiting payment" or "in progress".

Cancellation is free only if the Customer sends a specific written note to Compass DHM projects (in the manner specified below) within 2 hours of receipt of the Order Confirmation and no later than one hour before closing (from Monday to Friday, 19:00 (CET)). Therefore the cancellation request must be communicated from Monday to Friday no later than 18:00 (CET).

Requests for modification or cancellation of orders must be sent using the appropriate "Contact" form with the subject "Assistance" and must contain the order number and the reference account.  

In the event that these deadlines are not respected, the Customer will be charged a cancellation fee in the amount of 50% of the order value.

There is no cancellation of an order that includes a cut to size and / or a customized processing agreed with the Customer.

The possibility to modify or cancel an Order is subject to the consent of Compass DHM projects, which at its discretion, expressly reserves the right to make exceptions with respect to the clauses described here, in the event that it is not possible to accept the cancellation for causes of force majeure.

It is not possible to cancel an order once the shipping process has begun.
In the event that, at the time of canceling an order, the corresponding payment has already been made, it will be necessary to contact the Seller using the appropriate "Contact" form with the subject "assistance" to proceed with the refund procedure.  

In this case, the refund is activated by the Seller as quickly as possible and in any case within thirty (30) days from the sending of the order confirmation using, where possible, the same payment channel with which the order was placed.

 

Article 7 - Processing times, delivery of goods and retention of title  

Compass DHM projects ships the Products within the European Union, but reserves the right not to accept orders that have PO Boxes or other locations specified to the Consumer when placing the order.

The User can group multiple items in a single order. In this case he must add all the items to the cart and then proceed to complete the form.

The Seller does not group two or more orders placed separately. In this case, separate shipping costs will be applied and there will be no refund.

As for the packaging for small goods, padded envelopes are used. For bulky items, on the other hand, boxes and casings made specifically for greater resistance and protection are used.   

Packaging and shipping costs vary according to the number of objects, the type of packaging and the weight of the package.

The shipment is entrusted to the carrier according to the preparation and packaging times specified for each object on the website www.compassdhmprojects.it.

The delivery times indicated are purely indicative and not binding. They do not depend on the will of Compass DHM projects, which cannot be held responsible in any way for any delays due to facts of third parties or due to force majeure.

When placing the order, the Customer undertakes to enter a correct delivery address by checking any errors before confirming the order.

Given the type of packaging, damage to the pieces during transport is very rare.
Despite this, the goods travel at the risk and peril of the buyer, who, upon delivery of the material, must verify that the packaging is intact without any sign of tampering or damage.

In this case it is essential to sign the acceptance of the goods with reserve. If damage is verified, there are differences with respect to what was ordered or noted on the delivery document, these must be reported in writing to the Seller using the appropriate "Contact" form with the subject "Assistance", within 48 hours of receiving the package. 

If the package should return to our office due to the untraceable of the recipient, you will be charged for the costs of storage and return of the package.

For shipments to smaller islands or other remote areas there may be delays in delivery and additional management costs (to be paid by the Buyer).

The choice of the courier is at the discretion of the Seller.

Ownership of the goods is not transferred to the Customer until the final payment of the balance has been received by the Seller.

The buyer must pay all duties, excise duties, use and other taxes arising from this transaction (other than taxes based on the Seller's revenues).

 

Article 8 - Right of withdrawal

Purchases made from the website www.compassdhmprojects.it provide the Consumer with a period of 14 days to withdraw from the distance contract (as established by Legislative Decree 21/2014 which implemented Directive 83/2011 / EU on the rights of consumers). The fourteen days are understood to start from the moment in which the Consumer or a third party, other than the carrier and designated by the Consumer, acquires physical possession of the goods. 

It should be noted that Community legislation provides that the right of withdrawal can be exercised only by natural persons (consumers) who act for purposes that can be considered unrelated to their commercial activity. The right of withdrawal, therefore, CANNOT be exercised by legal persons and natural persons acting for purposes related to a commercial activity.

Purchases made by resellers or by subjects who in any capacity purchase for resale to third parties are also excluded from the right of withdrawal.

The right of withdrawal does not apply to the supply of tailor-made or personalized goods, the supply of sealed electronic material, or other goods which, by their nature, cannot be returned or are liable to deteriorate or expire rapidly.  

It is also specified that, in the case of prize operations (the so-called promotions), in which the purchase of an asset is combined with another asset that is sold at a lower price than the list price, the right of withdrawal will be legitimately exercised. with the return of both goods purchased, given the constraint of the accessibility of the goods in promotion with respect to the first.

No later than 14 days from the date of receipt of the goods (withdrawal period), the Consumer must inform us of his decision to exercise this right. To this end, the Consumer must use the withdrawal form provided directly by the Seller (upon explicit request) and forward it by e-mail to the following address: info@compassdhmprojects.it

The Products subject to reconsideration must be returned by the Consumer in conditions of substantial integrity (with traceable shipping). Once we have received the goods and verified their actual integrity, we will credit the Customer with the cost of the returned Products, withholding the amount of shipping and packaging costs paid at the time of purchase.

The costs and risks associated with returning the Products will be borne by the Customer.

The right of withdrawal is totally lost: if even partial use of the Product is ascertained, if the lack of integral elements of the Product (accessories, manuals, etc.) is ascertained, in the event of partial or total damage to the Product or parts of it , in case of absence or damage of the original packaging.

In the presence of one of the above conditions, no refunds or exchanges will be made.

 

Article 9 - Liability and guarantees

Compass DHM projects assumes no responsibility for disservices attributable to force majeure or unforeseeable circumstances, even if dependent on malfunctions and disservices of the internet network, which prevented, in whole or in part, from executing the order within the times provided for in the Contract. . Force majeure or unforeseeable circumstances means accidents, strikes, bad weather, fires, blackouts, executive difficulties, inability to obtain materials, equipment, labor or transport, government restrictions, serious disturbances to public health or any cause similar over which the Seller is unable to exercise any control.   

Compass DHM projects is also not responsible for any fraudulent or illegal use that may be made by third parties, credit cards or other means of payment, upon payment of the Products purchased on the website www.compassdhmprojects.it . In fact, at no time during the purchase procedure the Seller is allowed to know the Buyer's credit card number which, through a secure connection, is transmitted directly to the banking service manager.  

In the case of customized and / or customized products Compass DHM projects assumes no responsibility for the design of the items that are the subject of this transaction. The Customer assumes full legal responsibility for the project specifications and performance of the goods subject to this transaction. The suggestions for changes to the project, the advice and consultancy offered by the Seller's staff are given to meet the needs of the Customer, and therefore do not involve any type of responsibility attributable to Compass DHM projects. 

Article 10 - Protection of copyright

The information, logos, graphic elements, images, trademarks and anything else published and / or reproduced on the website www.compassdhmprojects.it are the property of Compass DHM projects, or granted by third parties for use by Compass DHM projects.

Reproduction of the content of the Site is permitted only with the prior written authorization of the Seller. It is therefore forbidden to reproduce, even partially, the textual and non-textual contents present on the Site - All rights reserved.

In any case, in compliance with current legislation, the European Commission provides a platform for the resolution of disputes online, without taking legal action, to obtain an out-of-court solution.
